Location: Embassy Suites Corpus Christi
Session Description
For the past several years, U.S. federal and state agencies have been ramping up their efforts to root out employees who have been misclassified as independent contractors. The distinction is important, because independent contractors generally aren’t protected by such things as discrimination laws, workers’ compensation, and wage and hour requirements. On March 11, 2024, the Department of Labor (DOL) raised the stakes by issuing new rules that make it more difficult to be an independent contractor.
In this session we will discuss:
- Why misclassification is a big deal
- The different federal and state tests to determine independent contractor status
- The DOL test established by the new rules
- How employers in various industries are likely to be impacted
